Buying in Cyprus: why the sale contract needs to be deposited
Payment, contract signing and title transfer can happen at different times. Check the deposited contract and registered burdens while transfer is pending.
The search certificate must disclose encumbrances and prohibitions and be dated within five working days either side of signing. The sale contract is generally deposited within six months. Deposit and title transfer are separate steps.
When buying a property under construction or awaiting title transfer in Cyprus, signing is followed by another step to track: depositing the sale contract with the Department of Lands and Surveys. DLS explains that deposit provides protection under the specific-performance framework if the seller fails to fulfil the contract.[1]
Separate deposit from title transfer
Deposit does not establish that a separate title has been issued or transferred into the buyer’s name. Delivery, approvals and registration need their own follow-up.
Ask the conveyancing lawyer to identify the signed contract, submission status, DLS acknowledgement and outstanding transfer issues. Keep the seller’s payment receipts and the official deposit record separately so that each can establish the step it actually proves.
Count six months from signing
The current service conditions require deposit within six months of signature. A court order allowing late deposit is a separate procedure.[1]
Allocate responsibility and a planned submission date when signing. Do not use the expected handover or residence-application date to calculate the deadline. If submission is delayed, obtain advice on the actual cause and available procedure rather than assuming it can always be remedied.
Read the burdens and prohibitions
New sale contracts covered by the December 2023 amendment require a search certificate showing encumbrances and prohibitions. The official FAQ calls for the parties’ initials on every page and accepts certificate dates within five working days before or after signing.[1][2]
Review the registered owner, mortgages, deposited contracts and restrictions. DLS also recommends checking legal access and planning or building issues.[4] A search certificate and an inspection answer different questions; marketing material cannot replace either.
Understand existing mortgage arrangements
For specified cases involving existing mortgages, DLS lists additional documentation. Form A addresses release following the specified payment; Form C records a buyer’s wish to deposit without Form A.[1]
Have the lawyer explain payment instructions, release conditions and the effect of the documents before signing. DLS’s 2026 announcement introduced an administrative-fines procedure with a 16 February–16 May transition period.[3] Enforcement does not replace the buyer’s transaction checks.
