Dominica citizenship deprivation notices: inquiry deadlines and procedure
A proposed-deprivation notice differs from a final order. The deadline for requesting an inquiry depends on how the notice applies.
For notice given by the Minister, the inquiry deadline is generally 21 days if the person is in Dominica, or a period of at least 21 days determined by the Minister otherwise. Diplomatic notices have separate adaptations; check the formal notice.
A notice proposing deprivation of Dominican citizenship is not a final deprivation order. Section 10 of the Citizenship Act requires advance written notice of the proposed grounds and the right to an inquiry.[1] First establish whether the document is a proposed notice, an information request or an operative order.
The notice should state the grounds and time limit
Regulation 16 in the law compilation published by CBIU allows personal delivery or posting where the person’s whereabouts are known, or posting to the last known address otherwise. For someone entitled to request an inquiry, the notice must state the application period.[1]
Do not calculate the deadline simply from when an email was opened or an agent mentioned it. Retain the notice and delivery records and examine its stated basis and deadline.
The 21-day rule depends on the circumstances
For notice given by the Minister, a person in Dominica when notice is given must apply within 21 days. In other cases, the Minister determines a period of at least 21 days. An extension is possible in special circumstances.[1]
Regulation 16(3) makes specific substitutions for notices given by a High Commissioner or Ambassador, including the relevant authority and location. Being abroad does not automatically confer extra time, and an extension is not automatic. Local counsel should assess the actual notice.
Who conducts the inquiry?
Following a request made in the prescribed manner, section 10(7) requires referral to a committee for inquiry and report. Its chair must have judicial experience.[1] This is distinct from a court appeal; requesting an inquiry does not itself withdraw the proposed action.
Any deprivation order must still satisfy section 10. The order gazetted in June 2024 invoked sections 10(2) and 10(5).[3] The 2024 investment regulations also provide for passport recall where citizenship has been deprived.[2] Confirm the document’s status and response deadline rather than relying on an unexpired passport.
