Avellino court refers Italy’s retrospective citizenship restrictions for review
The order published on 28 October is a referral, not a ruling striking down the restrictions.
Italy’s 28 October gazette published an 18 September Avellino court order referring the retrospective application of the 2025 citizenship restrictions to the Constitutional Court and requesting an interpretation from the EU Court of Justice. The case concerns minors born abroad who hold another nationality.[1]
The order suspended the underlying proceedings. It neither invalidated the restrictions nationally nor finally determined the applicants’ citizenship. The gazette publishes the referral order, not a final ruling by either receiving court.[1]
