South Africa clarifies asylum-application access despite procedural barriers
The 8 October statement concerns access to assessment, not automatic refugee status or residence.
South Africa’s Inter-Ministerial Committee on Migration confirmed on 8 October that refugee reception offices had been directed to receive and process applications from people expressing an intention to seek asylum, including those who entered irregularly and had previously been excluded by procedural requirements. The statement said offices could not deny access before lodgement on the basis of quotas, administrative restrictions or missing specified documentation.[1]
This clarification concerns access to an assessment, not automatic refugee status, permanent residence or indefinite permission to remain. Claims still require individual refugee-status determination. The statement also acknowledged conflicting judicial interpretations and further proceedings, so it should not be read as resolving every detention or removal issue.[1]
