South Africa reschedules asylum-detention hearing for 16–18 November

The court’s 28 October statement moves the hearing of 33 urgent applications from 29 October to 16–18 November, with a 6 November deadline for specified amicus applications.

South Africa · Court hearing rescheduled

South Africa’s Office of the Chief Justice announced on 28 October that the Gauteng High Court’s Johannesburg Full Court hearing on detention of prospective asylum seekers was moved from 29 October to 16–18 November 2026. Case 2026/220414 comprises 33 urgent applications.[1]

The proceedings concern detention of undocumented foreign nationals who express an intention to seek asylum and differing judicial approaches to the relevant Constitutional Court judgment. The court said the expanded proceedings and additional submissions require 3 hearing days. Anyone seeking admission as an amicus curiae on the specified constitutional issues must file an application and written submissions by 6 November.[1]

This is a procedural development, not a grant of asylum or residence permission or a ruling on the legality of detention. The government previously stated that existing court orders remain binding pending decisions in the subsequent proceedings. The postponement should not be read as a suspension of those orders.[1][2]
