UK sets out 10-year settlement framework in government response

The 2 November response sets out a 10-year starting point, faster routes and targeted transitional protections. Detailed implementing rules are still to follow.

The UK Home Office published its response to the earned settlement consultation on 2 November 2026. Its framework would raise the standard qualifying period from 5 to 10 years, with faster routes for sustained contribution. Publication of the response does not itself put every applicant on a 10-year route.[1]

Applicants would also face requirements covering character and suitability, debts owed to the government, English, the Life in the UK Test and sustained contribution. Relevant exemptions would apply, except in relation to criminality.[1]

The response refines family and vulnerable-group provisions and sets out targeted transitional protections, including for existing care workers and certain health and education workers. These should not be read as a blanket guarantee that all current visa holders retain the old arrangements.[1]

The Home Secretary told Parliament that rules would be laid from December 2026, with implementation during 2027. Detailed rules, operational guidance and a full impact assessment remain to follow; precise eligibility and commencement depend on those further measures.[1][2]

The planned framework provides a 3-year pathway for earnings of at least £125,141 in 3 of the preceding 4 years, and a 5-year pathway for at least £50,271 in 3 of the preceding 5 years. The thresholds are linked to income-tax bands and may change. Other mandatory requirements would still apply.[3]

Under the planned transitional arrangements, care workers who entered or switched into the route before the May 2025 Immigration White Paper would retain a 5-year qualifying period if they meet the £25,000 annual salary, sponsorship, employment and strengthened minimum requirements, subject to applicable exemptions. Those who do not qualify would be able to apply for a further 5-year Health and Care visa for genuine sector work, with no recourse to public funds, before seeking settlement again. This is not unconditional protection for every current care worker.[3]
