Canada implements asylum process changes on 3 November
IRCC confirms new filing, review and referral arrangements. The implementation date and the separate eligibility rules have different scopes.
IRCC says modernized asylum procedures took effect on 3 November 2026. Applicants first notify the government through its portal, then attend an interview to formally make their claim. Required reviews precede referral of eligible claims to the Immigration and Refugee Board. Referral does not mean asylum is granted.[1][2]
Eligible claimants have 60 days to submit a complete application and required documents, with one 30-day extension available on request. Changes also address withdrawal, abandonment, reinstatement and earlier designated representatives. Work permits remain conditional, including on complete submission, rather than automatic.[1]
The process changes took effect on 3 November. Separate additional eligibility restrictions apply to claims started after 2 June 2025. The portal-notification exception within one year of first entry concerns the one-year rule; it is not a general exemption from the US-border 14-day rule. Applicants should check the specific official exceptions.[1][2]
IRCC also records revocation of the temporary public policy for unaccompanied minors on 3 November, while continuing to apply it to eligible applications received by 2 November. Its updated asylum-process guidance still identifies unaccompanied minors as exempt, so the revocation should not be described as removal of that exemption.[3][2]
