Hong Kong New CIES: permanent residence and unconditional stay after seven years

Seven years of investment compliance and seven years of ordinary residence are different assessments. Under New CIES, continued financial compliance does not automatically confer permanent residence; unconditional stay provides a separate application route in specified circumstances.

Financial compliance does not establish ordinary residence

The Immigration Department states that maintaining New CIES financial requirements and receiving extensions for at least seven years does not establish that the entrant has met the ordinary-residence and other statutory requirements for right of abode.[1]

Keep the investment record distinct from the record of family life. One explains compliance with the scheme; the other helps explain the individual’s actual circumstances. Holding assets, maintaining an account and obtaining extensions should not separately be treated as findings of permanent-residence eligibility.

Ordinary residence calls for a factual account

When distinguishing temporary absence from the cessation of ordinary residence, the Department considers matters including the reason, duration and frequency of absence, habitual residence in Hong Kong, employment by a Hong Kong company, and the location of a spouse and minor children.[3]

Useful records therefore explain events rather than merely count border crossings. Overseas work, education and family care can have different contexts. Describe those contexts consistently with the underlying employment, housing and family documents.

An annual record of real changes can help. It does not make a particular lease, employment arrangement or pattern of visits a guaranteed route to approval.

Unconditional stay requires its own application

An entrant who cannot meet the continuous ordinary-residence requirement but has continuously met the portfolio-maintenance requirements for at least seven years may apply for unconditional stay. This permits entry and stay without conditions or a limit of stay; it is distinct from permanent-resident status.[1]

The New CIES Office requires verification of the relevant investment-compliance period before the application proceeds to the Immigration Department.[2] Reaching an anniversary is not itself a change of status.

Manage current deadlines while the application proceeds

The scheme includes anniversary portfolio submissions. Its procedures also require a timely extension application before the current stay expires, even if the relevant certifying proof has not yet been secured.[2]

Track anniversary compliance, the current limit of stay and the later status application separately. For each, record documents submitted, further requests and decisions. Family members’ documents and personal histories should be checked individually rather than reduced to the principal entrant’s calendar.

Wait for the relevant approval before arranging disposal

After permanent residence or unconditional stay has been obtained, the Immigration Department allows disposal of scheme investments subject to their underlying terms.[1]

The seventh anniversary, submission and approval are different events. Before selling or redeeming, establish the applicable approval position and check contractual lock-ups, redemption windows and settlement terms. An immigration outcome does not rewrite an investment contract.

Passport eligibility is a further question

An HKSAR passport requires Chinese citizenship, right of abode in Hong Kong and a valid Hong Kong permanent identity card.[4] Seven years of investment, unconditional stay or possession of a single document should not be presented as a promise of a Hong Kong passport.

Clarifying the family’s residence intentions and desired status at the outset makes the investment and record-keeping plan more useful. The eventual assessment must rest on the facts that actually developed, supported by the relevant evidence.
