Malaysia: the 90-day stay

Must the principal applicant personally spend 90 days a year in Malaysia? Age, approved dependants and the way days are counted all matter when deciding how long each family member will stay.

Start with the applicable age group

The official category table assigns a 90-day annual stay to the 25–49 age group in the federal Silver, Gold and Platinum categories. It lists no minimum stay for those aged 50 or above; the special-zone category has a separate 21–49 group.[1] Earlier approvals and the Sarawak or Sabah programmes need their own assessment.

Locate the category, principal applicant and validity dates in the approval documents before building a calendar. A birthday during the relevant year also deserves a specific enquiry: do not assume that turning 50 immediately changes how that year is assessed.

Understand the role of dependants

MOTAC describes 90 cumulative days per year and says that the principal or dependants may meet the younger group’s requirement. The category table likewise refers to the principal applicant, spouse and dependants, allowing the requirement to be met individually or together.[1][2] Neither explanation fully describes how overlapping stays by different people are counted.

Consider a hypothetical couple spending the same 45 days in Malaysia. The published wording alone does not establish that this produces 90 qualifying days. Give the proposed dates to the licensed agent and obtain clarification of the current approach before relying on combined days.

Keep a calendar that can be checked

Keep a separate record for each person showing arrival, departure and the passport used, then compare those dates with school terms, work and holidays. Retain the individual records before combining any figures under the confirmed counting method.

Confirm what “a year” means for the approval and how arrival and departure days are treated. Until those details are established, compare realistic travel options and allow room for change instead of booking a schedule that only just reaches the assumed total.

Coordinate the remaining conditions

The absence of a minimum stay in the older age group concerns that condition. The official table separately addresses deposits, housing and renewal.[1] Check each family member’s permission, expiry date and whether it permits their intended work or study.

A useful annual record identifies the category, the people meeting the stay requirement, the confirmed counting method and each person’s document expiry dates. Those details give the household a sounder basis for deciding when to travel and how long to remain.
